1. Acceptance & Definitions
By accessing, browsing, or using Fluxeno.pro (the "Website"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Fluxeno Pro GmbH ("Fluxeno Pro," "we," "us," or "our").
For the purposes of these Terms, "Services" encompasses all software development kits (SDKs), APIs, documentation, support forums, cloud infrastructure, and related tools provided by Fluxeno Pro, whether accessed through the Website or directly via developer portals. "Content" includes all text, graphics, code, and media published on the Website.
An indie developer from Hamburg integrates our SDK into a prototype. These terms govern that integration, outlining acceptable data use and liability limits.
You must be at least 18 years of age or have parental consent to use our Services. Account creation requires a valid email address.
Acceptable Use & Restrictions
We strive to maintain a professional and secure environment for all developers and gamers. To protect the integrity of the Fluxeno Pro ecosystem, certain activities are explicitly prohibited. This isn't about restricting creativity; it's about ensuring a stable, fair platform for everyone.
You agree not to use the Website or Services to: (a) upload or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable; (b) attempt to reverse engineer, decompile, or disassemble any software provided by Fluxeno Pro; (c) use automated systems to access the Website in a manner that sends more request messages than a human can reasonably produce; or (d) resell, sublicense, or commercially exploit the Services without a separate written agreement.
Community Impact
Violations may result in immediate suspension or termination of your account and access to our Services, without prior notice. We reserve the right to remove any Content that violates these Terms at our discretion.
Trade-offs & Mitigations
We enforce rules to protect the platform. Here’s how we balance enforcement with developer flexibility.
Limiting data aggregation ensures user privacy but can restrict analytics depth.
Protects infrastructure but can hinder large-scale batch processing during development.
Ensures a safe ecosystem but requires a review process for public-facing content.
3. Liability, Privacy & Governing Law
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FLUXENO PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY MISCONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES.
CRITICAL: Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Privacy & Data
Our use of your personal data is governed by our separate Privacy Policy. By using the Services, you consent to the data practices described therein. We adhere to the principles of the GDPR for users within the European Union. For detailed information on data processing, please refer to our Cookie Policy.
Governing Law
